THE AMERICAN CONSTITUTION AND ROE VS WADE

Wade, 410 U.S. 113 (1973),[1] was a landmark decision of the U.S. Supreme Court in which the Court ruled that the Constitution of the United States generally protects a pregnant woman's liberty to choose to have an abortion. The decision struck down many federal and state abortion laws,[2][3] and fueled an ongoing abortion debate in the United States about whether, or to what extent, abortion should be legal, who should decide the legality of abortion, and what the role of moral and religious views in the political sphere should be.  This week the world is in uproar and everyone is talking about one thing... ROE VS WADE. 

A court decision made 49 years ago that made ABORTION legal in the UNITED STATES OF AMERICA.

 And everyone is up in arms because abortion we are told... is a constitutional law and who the hell is anyone to tell me what I can do with my own body... what is the right way to think about this issue which affects men and women equally... ??? 

why is it important to men at all and why do men in a court room decide what I do with my own body?? So many issues to unpack... 

in this blog I will just speak my truth as a father...as a man... and as a legal mind. Its my truth so you dont have to agree with me ... but this is what I believe... 

 The court decision ROE VS WADE was CORRECT. Because it recognises the preservation of life as the highest option on the table. 

 Abortion is NOT a constitutional right at all- and bodily autonomy affects YOUR body- not one you are carrying. Thats thecsecond life that has no voice. Abortion is legal murder. And that is unconstitutional according to the founding framers. 

Yes..you do have a say in it.But we all do. Its a collective decision because children are a collective responsibility. 

 So what is the highest ethic??? ... its LIFE... and when the framers of the Constitution of America and the "Fathers" of THE constitituion( Jeffereson and Madison ) thought...designed..drafted  and wrote this document of governance they looked at a lot of thinkers and philosophers before them. It wasnt an easy document to write. Thats why you have amendments passed by law at judiciary level. 

They first held a convocation in 1787- 10 years after the declaration of independence... they invited scholars to participate , do due dilegence and they did in fact open up the drafting of the constitution to every American. It may have been male dominated but in fact there was a lot of female voices speaking too. 

In fact more than 26 Christian scholars were involved in the draft... 

and the great writer of the book "SPIRIT OF THE LAW"...Baron Montesquieu wrote there are 3 branches of governance... These were the precursors of the French and American revolutions. It was a shift in thought that impacted a monarchic world. 

Government had to be separated.   
 The Executive .. the Legislative ...and the JUDICIARY. This design is so that one power does not suppress the other and power itself is balanced. Thats the system.in place today which keeps society in America at least  together. 

The American government is designed in this way... you have the presidency ... the congress and the senate... and the supreme court.Its a broken democracy but its worked until now. And until power is completely decentralised and America becomes part of all the worlds legislative bodies eg the ICC .. its how it is. 
So sometimes ... one of those 3 ... make a decision that the majority of the people dont like.

Democracy and freedom go hand in hand.. but when it becomes a dictatorship as qe saw with the vaccine mandates.  not so long ago.  It breaks down.You cant cherry pick.. at least not until decision making becomes a collective democracy with every voter choosing every major decision. Thats why we vote in legislators or law makers.   We entrust them.

 ROE regretted her win and became a pro life advocate later on I am told. It doesnt matter... LIFE... is governed and protected by the tenets of the American consitution..and what exactly are those? - human rights? NO. 

 It talks about NATURES GOD... the highest reason to survival.... What would natures God do in any given situation... would that god defend him or herself from attack? 

- would that god defend life.... and it demarcates this from all else. Thats why they carry guns. THIS IS ETHICS. Its taking responsibility for the collective. true leadership. 

That is what fathers need to be doing today instead of being denigrated and set aside by the nanny state... the creation and the nurturing of life .... and the pursuit of happiness applies to all human beings... we are sentient... not separate. ALL OF US. 

You and I are part of this ONE planet. ONE EARTH. We breayh the same oxygen. 

Thats why capitalism in todays world....cannot work in the long run. So this is about the highest reason towards.. LIFE. And as long as you have an American constitution... that is how it goes. 

This is the core issue. As a father I see that to be self evident. 

No man and no woman is an island. we are all interconnected on planet Earth. Sooner or later we all must become sovereign and empowered. And if you want to get rid of the supreme courts decision..  you must get rid of the American constitution. We need then to become one country. One world. One Earth. One America. 
Some people say that bodily autonomy applies with vaccines... and they do... then abortion should also apply..but this isnt the highest dictum of the law...

 LIFE is... 

If LIFE is threatened ... and the mother of a new life ... carries that life inside of her for 9 months...it doesnt belong to her...and when her life is threatend by the life inside of her..

 YES... she should defend herself and abort. Thats Natures God...and that is the American constitution. If you dont like it..leave. 

 When people say its in the constuition... they should read it ... abortion is not in the constitution at all... its a great document that kept a great nation together ...and will continue to do so if its tenets are maintained.

 It was one of the worlds first written constitutions and it has helped to formulate a nation.

 the pursuit of life is a constuitional right... and that doesnt mean ego. everything ..especially FREEDOM is won at a price... like life... not every life that comes into this world is able to be born... but that is dependant on YOU giving it the chance to BE!

 If not then you become a nihilist. abortion kills and has killed over 60 million fetuses in the USA since this decision was made 49 years ago... abortion is NOT a constitutional right... LIFE is.

 And questions of life are always resolved in this way.. 

What would Natures God do?

And this is why the decision of the court was correct. Now... if it was in Strasbourg... or Geneva it would be different because they would look at it from purely a humanist way... and does this decision affect the state more than the individual... 

does it cause harm to the state ( although not always ) - a court often defends breaches of human rights by saying it will be too dangerous for the state to overturn this issue... 

but in america... a judiciary has to be ..completely independent from all branches of governance..it has to stick to the words of the constituiton and defend it to the hilt. 

 Thats the oath they took..and thats the oath that every american takes when they go to fight in a war or do anything important for the nation state... some may say its anarchic... 

and its not in lockstep with the rest of the world...

 But its AMERICA. Thats who they are.
